Terms of Service

Welcome to Hyperly. These Terms of Service ("Terms") govern your use of the Hyperly mobile application ("App") developed and published by Berke Tok ("Developer," "I," "me," or "my"), an independent developer. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Hyperly is a third-party mobile interface that allows users to interact with Hyperliquid, a decentralized perpetual exchange. The App provides:

  • A mobile interface to view market data and execute trades on Hyperliquid
  • Portfolio tracking and position management
  • Local price alert notifications
  • Wallet connection via WalletConnect

Important: Hyperly is NOT Hyperliquid. This is an independent third-party application that interfaces with Hyperliquid's public APIs. Hyperly is not affiliated with, endorsed by, or in any way officially connected with Hyperliquid.

2. No Data Collection

Hyperly does not collect, store, or transmit any user data. The App functions purely as an interface to Hyperliquid:

  • All data is stored locally on your device
  • All trading transactions occur directly on Hyperliquid
  • No personal information is collected or transmitted to any server
  • No analytics or tracking services are used
  • No account creation is required

3. Eligibility

To use the App, you must:

  • Be at least 17 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using cryptocurrency services under applicable laws
  • Not be a resident of a jurisdiction where cryptocurrency trading is prohibited
  • Comply with all applicable laws and regulations in your jurisdiction

4. Wallet Connection

4.1 No Account Required

Hyperly does not require account creation. You connect your existing cryptocurrency wallet to interact with Hyperliquid directly.

4.2 Wallet Security

You are solely responsible for:

  • Maintaining the security of your wallet and private keys
  • All activities that occur through your connected wallet
  • Ensuring your device is secure and not compromised

The App never has access to your private keys or seed phrases. Never share your private keys with anyone, including anyone claiming to represent Hyperly.

4.3 Agent Wallet

To enable seamless trading, the App may use Hyperliquid's agent wallet feature. This allows trades to be executed without requiring your signature for each transaction. The agent wallet has limited permissions and cannot withdraw funds from your account. You can revoke agent wallet access at any time through Hyperliquid.

5. Trading Risks

5.1 High Risk Activity

IMPORTANT WARNING: Cryptocurrency trading, especially perpetual futures trading with leverage, is extremely risky. You may lose all of your invested capital. Only trade with money you can afford to lose.

5.2 Specific Risks Include:

  • Market Volatility: Cryptocurrency prices can fluctuate dramatically in short periods
  • Leverage Risk: Trading with leverage amplifies both gains and losses
  • Liquidation Risk: Leveraged positions can be liquidated if the market moves against you
  • Smart Contract Risk: Hyperliquid operates on smart contracts which may contain vulnerabilities
  • Technology Risk: Network outages, software bugs, or cyberattacks may affect trading
  • Regulatory Risk: Cryptocurrency regulations may change and affect your ability to trade

5.3 No Financial Advice

Hyperly does not provide financial, investment, trading, or legal advice. Any information provided in the App is for informational purposes only. You should consult with qualified professionals before making any trading decisions.

6. In-App Purchases

6.1 Premium Features

The App offers optional premium features available through in-app purchases:

  • Alerts Pro - Unlimited price alerts
  • Portfolio Analytics - Advanced PnL tracking
  • Widget Pack - Home screen widgets and themes
  • Lifetime Bundle - All premium features

6.2 Payment Terms

  • All purchases are processed through the Apple App Store
  • Prices are displayed in your local currency
  • All purchases are one-time payments, not subscriptions
  • Payments are non-refundable except as required by applicable law

6.3 Refunds

Refund requests must be submitted through Apple's refund process. The Developer does not have the ability to process refunds directly.

7. Prohibited Activities

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to interact with the App
  • Engage in market manipulation or fraudulent trading activities
  • Use the App to launder money or finance illegal activities
  • Impersonate others or misrepresent your identity

8. Intellectual Property

The App and its original content, features, and functionality are owned by Berke Tok and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without written permission.

9. Third-Party Services

The App interfaces with third-party services including Hyperliquid and WalletConnect. Your use of these services is governed by their respective terms and policies. The Developer is not responsible for the content, privacy practices, or conduct of third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY OR FREEDOM FROM VIRUSES

The Developer does not warrant that the App will meet your requirements or that any errors will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER (BERKE TOK) SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any trading losses, including losses from liquidations
  • Any damages arising from your use of third-party services
  • Any damages resulting from unauthorized access to your wallet

IN NO EVENT SHALL THE DEVELOPER'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Developer (Berke Tok) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your trading activities

13. Termination

The Developer may terminate or suspend access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your license to use the App is revoked
  • You must delete the App from your devices
  • Premium features you purchased will no longer be accessible

You may stop using the App at any time. Termination does not affect any rights or obligations arising before termination.

14. Changes to Terms

The Developer reserves the right to modify these Terms at any time. You will be notified of material changes by posting the updated Terms in the App or on the website. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through the courts of the Republic of Turkey.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements.
